These Terms of Service constitute the agreement between utkarshita and the customer. Accessing the site or placing an order constitutes acceptance of them.
Scope. These Terms govern access to and use of the utkarshita website and the purchase of pieces through it. The Shipping Policy and the Cancellations & Returns Policy form part of these Terms. The Privacy Policy governs the handling of personal data.
1.Accounts and identity
Access is authenticated by mobile number and a one-time passcode. The registered mobile number constitutes the account identity.
- 1(a)The customer is responsible for maintaining control of the registered mobile number. Any person able to receive the one-time passcode is able to access the account.
- 1(b)The customer must notify utkarshita promptly where they believe the account has been accessed without authorisation.
2.Orders and pricing
All prices are stated in Indian Rupees and are inclusive of applicable taxes. The total presented at checkout is computed on utkarshita's servers from the cart at that moment and is the price for that order. It is not altered after the order is placed.
- 2(a)Placing an order constitutes an offer to purchase. A contract is formed when utkarshita confirms the order.
- 2(b)utkarshita may decline an order it cannot fulfil, including in the case of a pricing error, a piece no longer available, or an address it cannot serve. Where an order is declined, the customer is notified and is not charged.
3.Payment
Cash on Delivery is accepted where the order is eligible. Where online prepaid payment becomes available, it is processed by a payment provider; card details are not stored on utkarshita's systems.
4.Delivery, cancellation and returns
Delivery is governed by the Shipping Policy. Cancellation and return are governed by the Cancellations & Returns Policy. Both form part of these Terms.
5.Intellectual property
The text, photography, design and editorial documentation published on the site are the property of utkarshita or are used under licence. They may not be reproduced for commercial purposes without written consent.
The handloom traditions documented on the site are the cultural property of the communities that maintain them. utkarshita documents and presents those traditions; it does not claim them.
6.Acceptable use
The site is provided for genuine personal shopping.
- 6(a)The customer must not attempt to disrupt, degrade or gain unauthorised access to the site or its systems.
- 6(b)The customer must not access the site by automated means without prior written permission.
- 6(c)The customer must not use the site to infringe the rights of any person.
7.Liability
Pieces are described with care. Variation in weave, motif and colour is inherent to handloom and is not a defect.
To the extent permitted by law, utkarshita's liability in respect of an order is limited to the value of that order.
8.Governing law and amendment
These Terms are governed by the laws of India.
utkarshita may amend these Terms. The effective date and revision date stated at the head of this document identify the operative version.
